RULES OF THE INTERNET SHOP Mosali.pl From 25.08.2017

  1. Definitions

    The terms used in the Regulations mean:

    1. Client – a natural person, legal entity or organizational unit not a legal entity whose special provisions confer on the legal capacity that makes a Purchase Order within the Store;
    2. Consumer – according to art. 22 [1] of the Civil Code means a natural person who performs a business activity with a trader not directly related to his business or profession.
    3. Civil Code – Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
    4. Regulations –these Terms and Conditions of providing services by electronic means within the shop www.mosali.pl;
    5. Online shop – an internet service available at www.mosali.pl, through which the Customer may in particular place Orders;
    6. Goods – products presented at the Internet Shop;
    7. Sale Agreement – Contract of Sale of Goods within the meaning of the Civil Code, concluded between Factory BS sp. Z o.o. sp. k., and the Customer, made using the Shop's web site;
    8. Consumer Rights Act – Law of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);
    9. Electronic Services Act – Act of 18 July 2002 on providing services by electronic means (Journal of Laws No. 144, item 1204, as amended);
    10. Order – statement of the will of the Customer, aiming directly at the conclusion of the Sales Agreement, specifying in particular the type and number of the Goods.
  2. General provisions
    1. These Regulations set out the rules for using the online store available at: www.mosali.pl.
    2. These Regulations are the regulations referred to in art. 8 of the Act on providing services by electronic means.
    3. The online shop, run at: www.mosali.pl, is run by Factory BS sp. Z o.o. Sp. K ..
    4. These Regulations specify in particular :
      1. rules of registration and use of the account within the online store;
      2. the terms and conditions for electronic booking of products available through the online store;
      3. terms and conditions of electronic submission of Orders within the online store;
      4. Rules for concluding Sales Contracts with the use of services provided within the Online Store.
    5. Use of the online store is subject to the condition that the IT system used by the customer to meet the following minimum technical requirements:
      1. Internet Explorer version 10,0, or
      2. Mozilla Firefox version 11 or later, Opera version 7.0 and higher, or Google Chrome version 12.0.0 or later,
      3. Any screen resolution.
    6. In order to use the online store, the customer should have access to a computer terminal or Internet access terminal.
    7. According to the valid legal regulations of Factory BS sp. Z o.o. Sp. L. Reserves the right to limit the provision of services through the Online Shop to persons over the age of 18 years. In this case, potential customers will be notified of the above.
    8. Customers may access these Terms and Conditions at any time via the link on the main website www.mosali.pl and download and print it.
  3. Terms of Use of the Online Shop
    1. The condition to start using the Online Store is to register within it.
    2. Registration is by completing and accepting the registration form available on one of the Shop pages.
    3. Registration is required to agree to the content of the Terms and to provide personal information marked as mandatory.
    4. The BS Factory may deprive Customer of the right to use the Internet Store and may limit its access to some or all of the resources of the Internet Store, with immediate effect, in the event of Customer's breach of these Terms and Conditions, and in particular when Customer:
      1. When registering on the Internet Shop, you have provided inaccurate, inaccurate or outdated information that is misleading or infringes on the rights of third parties,
      2. Has committed through the Online Shop infringement of personal rights of third parties, in particular the personal rights of other customers of the Online Shop,
      3. Other behaviors that will be recognized by Factory BS for behavior that is inconsistent with applicable laws or general Internet usage rules, or which fall under the goodwill of the BS Factory shall be admissible.
    5. A person who has been deprived of the right to use the Online Shop may not re-register without the prior consent of Factory Bs sp. Z o.o. Sp. K .
    6. In order to ensure the safety of the transmission of messages and data in connection with the services provided within the Site, the Online Shop shall take technical and organizational measures appropriate to the security risk of the services provided, in particular measures to prevent the unauthorized access and modification of personal data transmitted on the Internet.
    7. The client is obliged in particular to:
      1. Failure to provide and not to transmit content prohibited by law, such as content promoting violence, defamatory or infringing personal and other rights of third parties,
      2. Use of the Online Store in a way that does not interfere with its operation, in particular by using specific software or hardware,
      3. Do not take action such as sending or posting unsolicited commercial information (spam) within the Online Shop.
      4. Use the Online Store in a way that is easy for other customers and for Factory BS,
      5. Use of any content contained within the Online Shop only for your personal use,
      6. Use of the Internet Store in a manner consistent with the law of the Republic of Poland, the provisions of the Regulations, as well as the general rules of using the Internet.
  4. Procedure for conclusion of the Sale Agreement
    1. Information on the Goods given on the website of the Shop, in particular their descriptions, technical and utility parameters and prices, is a call for conclusion of a contract within the meaning of art. 71 Civil Code.
    2. In order to conclude the Sales Agreement via the Online Shop, please go to the website www.mosali.pl, select the product and its color, taking further technical steps based on the displayed messages and the information available on the website.
    3. The selection of goods ordered by the Customer is made by adding them to the cart.
    4. When ordering - until you press "eg. I order with payment obligation or other equivalent informing about the obligation to pay. "- The customer has the possibility to modify the entered data and selected goods. For this purpose, you should follow the displayed messages and information available on the website.
    5. Once the Customer using the Internet Store has given all the necessary data, a Summary of the Order is displayed. A summary of your Order will include information on:
      1. Object of the order,
      2. unit price and total price of ordered products or services, including delivery costs and additional costs (if any),
      3. chosen payment method,
      4. chosen delivery method,
      5. Delivery time,
    6. In order to send the Order, it is necessary to accept the content of the Regulations, provide the personal information marked as mandatory and press the button "I order and pay".
    7. Sending the Order by the Client is a statement of will to conclude with Factory BS sp. Z o.o. sp. k Contract of sale, in accordance with the Terms and Conditions.
    8. After placing the Order, the Customer receives an email entitled "Order Confirmation", containing the final confirmation of all relevant elements of the Order.
    9. The agreement is treated as concluded with the moment the Customer receives the email mentioned above.
    10. The sales contract is concluded in Polish, with the content in accordance with the Regulations.
    11. Customers may access these Terms and Conditions at any time via the link on the main website www.mosali.pl and download and print it.
    12. Fixing, securing and making available the Order and the General Terms and Conditions (online store rules) is by e-mail.
  5. Supply
    1. Delivery of Goods is limited to the territory of the Republic of Poland and takes place at the address indicated by the Customer during the Order submission.
    2. Delivery of ordered goods takes place by courier UPS. Shipping costs are http://mosali.pl/Wysylka-cterms-pol-14.html. Shipping costs will also be indicated at the time of placing the Order.
    3. Delivery deadline is from 1 to 7 working days counting from the day the Customer sends the Order.
  6. Prices and payment methods
    1. Commodity prices are quoted in Polish zloty and include all ingredients, including VAT (with the premium rate), customs and all other ingredients.
    2. The customer is able to pay the price:

      2. Payment in the electronic payment system,
      3. Payment by credit card,
      4. For downloading.
  7. Right to withdraw from the contract
    1. Only a Customer who is simultaneously a Consumer shall have a 14 day cancellation period. The consumer has the right to withdraw from this contract within 14 days without giving any reason. The expiry date will expire 14 days after the date on which you came into possession of the property or a third party other than the carrier and indicated by you has entered into the ownership of the property.
    2. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by completing and returning to our mailing address (by mail or electronically) a complaint / return form.
    3. To keep the withdrawal deadline, you only need to send information on the exercise of your right of withdrawal before the expiration of the withdrawal period.
  8. Consequences of withdrawal
    1. In the event of withdrawal from this contract, we will refund all payments received from you, including the cost of delivery of the item (except for the additional costs of your choice of delivery other than the cheapest delivery method offered by us), promptly and in any event no later than 14 days from the date we were informed of your decision to exercise your right of withdrawal from this contract. We will reimburse you using the same payment methods you used in your original transaction unless you have explicitly agreed otherwise. In any case you will not incur any charges in connection with this return.
  9. Complaints about Goods
    1. Factory BS sp. Z o.o. sp. k. as the seller is liable to the consumer being a consumer within the meaning of art. 22 [1] of the Civil Code, in respect of defects for defects in the scope of the Civil Code, in particular art. 556 and Art. 556 [1] - 556 [3] and subsequent Civil Code.
    2. Complaints arising out of breach of statutory rights, or pursuant to these Regulations, should be addressed to info@mosali.pl. Factory BS sp. Z o.o. sp. k. undertakes to consider each complaint within 14 days. Failure to adjudicate a complaint within the above deadline means that it is justified.
    3. Factory BS sp. Z o.o. Sp. K. Is a producer of goods. The manufacturer shall be liable under the guarantee of the goods sold under the terms and for the period indicated in the warranty card. If the warranty document provides such an opportunity, the customer can claim his / her warranty claims directly at an authorized service center whose address is included in the warranty card.
  10. Complaints regarding the provision of services by electronic means
    1. Factory BS sp. Z o.o. Sp. K. Undertakes actions to ensure that the Shop is fully functioning properly to the extent that it is based on current technical knowledge and undertakes to remove, within a reasonable time, any irregularities reported by the Customer.
    2. The Client is obliged to immediately notify Factory BS sp. Z o.o. sp. k. of any abnormalities or interruptions in the functioning of the Internet Store.
    3. Abnormalities related to the functioning of the Store Customer may report in writing to: Factory BS sp. Z o.o. Sp. K. Ul. Opolska 1/4, 42-274 Konopiska, mail to info@mosali.pl or using the contact form.
    4. In the complaint, the Client should give his name, address for correspondence, type and date of occurrence of anomalies related to the functioning of the Store.
    5. Factory BS sp. Z o.o. Sp. K. Undertakes to consider each complaint within 14 days. Failure to adjudicate a complaint within the above deadline means that it is justified.
  11. Settlement of disputes and final provisions
    1. A customer who is a consumer may be able to use out-of-court complaint and redress procedures. Disputes concerning online purchases can be solved through mediation proceedings before the Voivodship Inspectorates of Trade Inspection or a trial before an arbitration court at the Provincial Inspectorate of Trade Inspection. The consumer may also use other means of extrajudicial dispute resolution and, for example, file his complaint through the EU-based ODR web site, available at: http://ec.europa.eu/consumers/odr/
    2. In the absence of interest from the consumer for the possibility of using out-of-court dispute resolution, the settlement of any disputes arising between Factory BS sp. Z o.o. sp. k. a Consumer will be submitted to the appropriate courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
    3. Settlement of possible disputes arising between Factory BS sp. Z o.o. sp. k. and a Customer who is not simultaneously a Consumer shall be subject to the court of competent jurisdiction for the domicile of Factory BS sp. z o.o. Sp. K ..
    4. In matters not regulated in these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Polish law shall apply.
